Terms of Service
These Terms of Service govern your use of Collaborative Marketing and the services we provide. By creating an account or using our platform, you agree to these terms. Please read them carefully — we've kept the language as plain as possible.
Short version: You pay us monthly, we run your marketing campaigns. You can cancel anytime before your next billing date. After we've launched your campaign, we don't issue refunds for the current billing period. We do our best — but marketing results are never guaranteed.
1. Acceptance of terms
By accessing or using the Collaborative Marketing platform ("Service"), you confirm that you are at least 18 years old, have the legal authority to enter into this agreement (either personally or on behalf of a business), and agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these terms, do not use our Service.
2. Our services
Collaborative Marketing provides AI-assisted digital marketing services to businesses on a monthly subscription basis. Depending on your plan, services may include:

Each plan includes progressively more features as described on our pricing page and in your client dashboard. The specific deliverables for each plan may be updated from time to time. We will notify you of any material changes to what is included in your plan.
We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice.
3. Your account
You are responsible for:
- Maintaining the confidentiality of your account password
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access to your account
You may not share your account with others or create multiple accounts for the same business without our written consent.
4. Payment & billing
Subscription billing: Collaborative Marketing is billed on a monthly subscription basis. Your subscription begins on the date your first payment is processed and renews automatically each month on the same date.
Payment processing: All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on file each month until you cancel. We never store your credit card details directly.
Failed payments: If a payment fails, we will retry automatically up to 3 times over the following days. If payment continues to fail, your subscription will be paused and your campaigns will stop running. You will receive email notifications throughout this process.
Price changes: We may change our subscription prices with at least 30 days' advance notice by email. The new price will take effect on your next renewal date after the notice period.
Taxes: Prices do not include applicable taxes (sales tax, VAT, GST, etc.). You are responsible for any taxes applicable to your subscription.
5. Cancellation policy
Simple rule: Cancel before your next billing date and you won't be charged again. Cancel after we've launched your campaign and you keep access through the end of your current billing period — no refund for that period.
Before campaign launch: If you cancel before we have launched your campaign (typically within the first 48 hours after payment), you are entitled to a full refund of your most recent payment. To request a pre-launch cancellation, contact us within 48 hours of your payment.
After campaign launch: Once your campaign has gone live, we have already begun performing work on your behalf (creating content, setting up ads, etc.). In this case:
- You may cancel your subscription at any time
- Your subscription will remain active through the end of the current billing period
- No refund will be issued for the current billing period
- You will not be charged for any future billing periods after cancellation
How to cancel: You can cancel your subscription at any time through your client dashboard by clicking "Manage Billing" and following the prompts in the Stripe billing portal. Cancellation requests must be made at least 24 hours before your renewal date to take effect for that billing cycle.
Data after cancellation: After cancellation, your campaign data and account information will be retained for 30 days. During this period, you may reactivate your subscription and pick up exactly where you left off. After 30 days, your data will be archived in accordance with our Privacy Policy.
No refunds for results: Marketing results (leads, clicks, sales) are never guaranteed. We cannot issue refunds based on dissatisfaction with campaign performance, as results depend on many factors outside our control including your industry, competition, ad spend, and market conditions.
6. Your responsibilities
To allow us to provide effective marketing services, you agree to:
- Provide accurate information — All business information, campaign goals, and content you provide must be truthful and accurate. Providing false or misleading information about your business is grounds for immediate termination.
- Respond to communications — We may need your input, approvals, or feedback during campaign setup. Delays in your responses may delay campaign launch or impact results.
- Grant necessary permissions — For campaigns requiring access to your Google Business Profile, ad accounts, or social media accounts, you agree to grant us the access needed to manage campaigns on your behalf.
- Comply with platform policies — Your business and the products/services being advertised must comply with Google Ads, Meta Ads, and other platform policies. We cannot run campaigns for prohibited products or services.
- Own or have rights to your content — Any logos, images, copy, or other materials you provide to us must be owned by you or properly licensed. You are responsible for any intellectual property claims arising from content you provide.
You agree not to use our Service for any illegal purpose, to violate any applicable law, or to promote products or services that are prohibited by law or by advertising platform policies.
7. What we commit to
We commit to:
- Delivering the services described in your plan in a professional and timely manner
- Providing you with monthly reports detailing the work completed
- Communicating proactively if something is delayed or if we need information from you
- Keeping your business information and campaign data confidential
- Using commercially reasonable efforts to achieve strong campaign results
No guarantee of results: While we use professional techniques and AI-assisted strategies, we cannot guarantee specific outcomes such as a certain number of leads, a specific return on ad spend, or particular rankings. Marketing is inherently variable and results depend on many factors outside our control.
7a. AI-Generated Content Disclaimer
Content generated by our AI tools is provided as-is. While we strive for accuracy and quality, AI-generated content should be reviewed before publication. Collaborative Marketing is not liable for claims arising from AI-generated content published without review.
7b. White-Label Terms
Agency plan subscribers who utilize white-label features are solely responsible for their end-client relationships, billing, and support. Collaborative Marketing provides the platform infrastructure but does not enter into any agreement with the Agency's clients.
8. Intellectual property
Your content: You retain full ownership of your brand, logo, business name, products, services, and any original content or materials you provide to us. Granting us access to create campaigns does not transfer ownership of your intellectual property.
Campaign content we create: Content created by Collaborative Marketing specifically for your campaigns (social media posts, ad copy, images, etc.) becomes yours upon payment. You own the deliverables we create for you.
Our platform: The Collaborative Marketing platform, including its software, design, AI systems, tools, and methodologies, remains our exclusive property. You may not copy, reverse engineer, or create derivative works from our platform.
9. Limitation of liability
To the maximum extent permitted by applicable law:
- Collaborative Marketing's total liability to you for any claim arising from these terms or our services shall not exceed the total amount you paid us in the 3 months preceding the claim.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of business opportunities.
- We are not liable for the performance of third-party advertising platforms (Google, Meta, etc.), including their policy changes, algorithm updates, or account suspensions.
- We are not liable for results that fall below expectations when we have fulfilled our contractual deliverables in good faith.
Some jurisdictions do not allow limitations on liability for certain types of damages. In such cases, our liability will be limited to the minimum extent permitted by applicable law.
10. Disputes

These Terms of Service are governed by the laws of the jurisdiction in which Collaborative Marketing is registered. Any unresolved disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
11. Termination
We may terminate or suspend your account immediately, without prior notice, if:
- You materially breach these terms and fail to remedy the breach within 7 days of notice
- You provide false or fraudulent information
- You use our Service for illegal purposes or in violation of applicable law
- Continuing to provide services would expose us to legal or reputational harm
Upon termination by us for cause, you will not be entitled to a refund for the current billing period. If we terminate your account without cause, we will provide a prorated refund for unused days in your current billing period.
You may terminate your account at any time per Section 5 (Cancellation Policy).
12. Changes to these terms
We may update these Terms of Service from time to time. When we make material changes, we'll notify you by email at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.
